1. Agreement to Terms

By accessing or using the NearClean platform at nearclean.co.uk ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

You must be at least 18 years old to use NearClean. By using the Platform, you confirm that you are at least 18 years of age.

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

2. Our Services

NearClean is an online marketplace that connects customers seeking cleaning services with independent cleaning businesses. We provide a platform for:

• Discovering cleaning businesses in your area
• Viewing business profiles, services, and pricing
• Booking cleaning services online
• Managing bookings and communicating about appointments
• Processing payments securely

We strive to ensure the quality of businesses on our platform but cannot guarantee the quality, safety, or legality of services offered by any business.

3. User Accounts

Account Types

• Customer accounts — for individuals seeking cleaning services. Allows booking, payment, and review of services.
• Business accounts — for cleaning service providers. Allows listing services, managing bookings, scheduling staff, and receiving payments.
• Staff accounts — created by businesses for their employees. Provides limited access to assigned bookings and schedules.

Your Responsibilities

• You are responsible for maintaining the security of your account credentials
• You must provide accurate and up-to-date information
• You must not share your account with others or create multiple accounts
• You must notify us immediately if you suspect unauthorised access to your account

4. Bookings and Payments

Making Bookings

• Bookings made through the Platform are requests to the cleaning business. They are confirmed once the business accepts the booking.
• Prices are set by the individual cleaning businesses. NearClean does not control or set service prices.
• You should review the service details, pricing, and any terms set by the business before confirming a booking.

Payments

• Payments are processed securely through Stripe. By making a payment, you also agree to Stripe's terms of service.
• NearClean may charge a platform fee on bookings, which will be clearly shown before payment.

Cancellations and Refunds

• Cancellation policies are set by individual businesses and shown at the time of booking.
• Refund requests should be directed to the cleaning business in the first instance.
• If you are unable to resolve a dispute with a business, you may contact us for assistance at admin@nearclean.co.uk.

Recurring Bookings

• Recurring bookings will continue at the agreed frequency until cancelled by you or the business.
• You can cancel or pause a recurring booking series at any time through your account.
• Changes to recurring booking pricing will be communicated in advance by the business.

5. User Responsibilities

All Users

You agree not to:

• Use the Platform for any unlawful purpose
• Provide false, misleading, or inaccurate information
• Impersonate any person or entity
• Harass, abuse, or threaten other users
• Attempt to gain unauthorised access to any part of the Platform
• Use the Platform to send spam or unsolicited communications
• Interfere with the proper functioning of the Platform

Customers

• Provide accurate service addresses and access instructions
• Be available or make arrangements for access at the booked time
• Pay for services as agreed
• Treat cleaning professionals with respect

Businesses

• Provide services as described in your listing
• Maintain appropriate insurance for your cleaning services
• Honour confirmed bookings or provide reasonable notice of cancellation
• Comply with all applicable laws and regulations
• Keep your profile, services, and pricing up to date

6. Limitation of Liability

NearClean acts as a marketplace platform connecting customers with independent cleaning businesses. Accordingly:

• We are not liable for the quality, safety, or legality of cleaning services provided by businesses on the Platform.
• We are not liable for any disputes between customers and businesses, including property damage, unsatisfactory service, or payment disputes.
• We are not responsible for any loss or damage arising from your use of the Platform, except where caused by our negligence.
• Our total liability to you shall not exceed the total amount you have paid through the Platform in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

7. Intellectual Property

• The NearClean name, logo, design, and all Platform content created by us are our intellectual property.
• Content you submit to the Platform (such as business profiles, reviews, and photos) remains yours, but you grant us a licence to display it on the Platform.
• You must not copy, reproduce, or redistribute any part of the Platform without our written permission.

8. Termination

• You may close your account at any time by contacting us at admin@nearclean.co.uk.
• We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or behave in a way that is harmful to other users or the Platform.
• Upon account closure, your personal data will be handled in accordance with our Privacy Policy.
• Any outstanding booking obligations or payment obligations survive account termination.

9. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
